Organizacja administracji rządowej w Polsce

Abstract

Przedmiotem niniejszego artykułu jest wskazanie miejsca rządowej władzy wykonawczej w rozległym systemie prawa administracyjnego. Praca ukazuje strukturę organów egzekutywy oraz ich hierarchiczne relacje na różnych szczeblach i w rozmaitych formach. Omówiono ustrojowe podstawy jej prawnego bytu oraz wskazano najważniejsze zadania i kompetencje. Treść pracy odwołuje do aktualnego stanu faktycznego reprezentacji władzy wykonawczej. Uwagę poświęcono procesom stosowania prawa – w ramach organizacyjnej siatki administracji rządowej, której zagnieżdżenie odpowiada istotnej zasadzie konstytucyjnej: centralizacji i dekoncentracji rządu wobec decentralizacji organów samorządowych. W tym zakresie wskazano rolę wojewody jako reprezentanta Rady Ministrów w terenie i naszkicowano tryb, w jakim koresponduje on z organami samorządu. Ze względu na rozległość tematyczną zagadnienia, praca dotyka jedynie podstawowych, a zarazem najważniejszych celów i założeń funkcjonowania rządu RP, a kwestie szczegółowe ujęto w formie licznych odwołań, bibliografii i wykazów aktów normatywnych.

The subject of this article is to indicate the place of the executive government in an extensive system of administrative law. The following study presents the structure of executive organs and their hierarchical relations at various levels and forms. System foundations of its legal existence were discussed, and the most significant tasks and competences were pointed out. The content of the presented study refers to the current state of the executive authority. Particular attention was devoted to law enforcement processes – within the framework of the organizational network of governmental administration, which entity corresponds to an important constitutional principle: centralization and deconcentrating of the government towards the decentralization of local government bodies. In this regard, the role of the provincial governor as a regional representative of the Cabinet was indicated and the mode in which the provincial governor corresponds with local government bodies was outlined. Due to the thematic scope of the issue, the paper focuses only on the basic and also the most important aims and assumptions of the Polish government functioning. Specific issues are included in the form of numerous references, bibliographies and lists of normative acts or legal texts.
